India’s new social media rules come at a time the US, the UK, and Australia—among other nations—have been pushing Facebook, WhatsApp, Twitter, Instagram, and their ilk to take responsibility for the content on their platforms. The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (the “Intermediary Rules”) fundamentally change the way the internet will be experienced in India. ·         a Chief Compliance Officer

·         a Nodal Contact Person

·         a Resident Grievance Officer

Chief Compliance Officer to tackle the complaints and make the report, to present before the government, Nodal contact officer will be any government officials who will have contact with the ministries and explain new laws to the company and Resident Grievance the officer will represent the company in the government report submission. The Rules also necessitate significant social media intermediaries to have a physical contact address in India. This mandatory physical presence in India will have significant implications for foreign players in terms of setting up infrastructure and deployment of resources and taxation.

 

 

After the departure of Information Technology (Intermediary Guidelines) Rules, 2011 (2011 Rules), all social media and OTT platforms will now require to deploy technology-based measures, including automated tools to identify informa
tion that depicts rape, child sexual abuse or conduct, or information that has previously been removed. Which would also have parents lock if applicable so that children can’t access the implicit contents that are marked as U+18. watching the U+18 will also have a code verification in the respective id’s which will restrict the person to circulate the contents.

 

 

Messaging services (with more than 50 lakh users) will be required to enable identification of the first originator of information if required by a court order or an order of the government under Section 69 of the IT Act. which will enable the government to trace the imposter who has caused any riots or brawls, so that the person who has planned  to destroy the peace will get the punishment and circulation of such messages can stop in time.
